2257 Compliance Statement - hdmomtube.com

All models, actors, actresses and other persons that appear in any image or video, whether of actual or simulated sexual behavior or otherwise, that appears on the website were over the age of eighteen years at the time of the creation of such.

Exemption: Content Produced by Third Parties

hdmomtube.com is not a "producer" (primary or secondary) of any visual content depicting real or simulated sexual conduct, explicit or otherwise, found on the website. The operator of hdmomtube.com confines their activities with regard to sexually explicit content provided by third-party users to transmission, storage, retrieval, hosting, or formatting only. All content that is furnished by third-party users is featured on areas of hdmomtube.com which are under the control of third-party users. The operators are therefore exempt from compliance with Section 2257 records keeping and labeling obligations pursuant to 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may delete any materials if such are determined, at the sole discretion of the operator, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.

Any visual depictions that may appear on the website, for which the operator of the website may be considered the “producer,” are not subject to the conditions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not portray any sexually explicit acts as laid out in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not portray depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not portray simulated sexually explicit behavior; or (4) the images or videos were produced before July 3, 1995.
